B-BBEE Affidavit for EME: Complete Guide

If your business has annual turnover under R10 million, you qualify as an Exempt Micro Enterprise (EME) and can use a B-BBEE affidavit instead of paying for a verified certificate.

What is an EME?

An Exempt Micro Enterprise is a business with:

• Annual turnover of R10 million or less
• Any level of black ownership

As an EME, you automatically qualify for either:

• Level 4 B-BBEE status (less than 51% black owned)
• Level 1 B-BBEE status (51% or more black owned)

Do I Need a Certificate or Affidavit?

What Must the Affidavit Include?

Your B-BBEE affidavit must state:

• Company name and registration number
• Annual turnover is under R10 million
• Percentage of black ownership
• That the information is true and correct
• Signed before a Commissioner of Oaths

How to Get Your Affidavit

• Draft the affidavit using the DTI template
• Complete the details - company name, registration, turnover
• Sign before Commissioner of Oaths - police station or attorney
• Get it stamped - must have official stamp

Where to Find a Commissioner of Oaths

• Any police station (free)
• Attorneys (may charge R50-R100)
• Post Office

How Long is it Valid?

A B-BBEE affidavit is valid for 12 months from the date of signing. You'll need to renew it annually.

Common Mistakes

• Not signed before Commissioner - it's not valid without the stamp
• Wrong turnover calculation - must be annual turnover
• Expired - tenders require current documents
• Missing company details - must have registration number

When You Need a Certificate Instead

You need a verified B-BBEE certificate if:

• Turnover exceeds R10 million
• Tender specifically requires verified certificate
• Working with large corporates who require verification
