1. Acceptance of Terms

By accessing, using, or registering for SiteReady ("Service", "Platform", "we", "our"), you ("User", "you") accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Service.

2. Description of Service

SiteReady is a document generation platform that helps South African contractors create:

SHEQ compliance documents (safety files, health and safety plans, risk assessments)
Tender pack documents for government and private sector tenders
Company profile documents
B-BBEE and CSD declarations

Our Services are provided via web dashboard and WhatsApp bot.

3. IMPORTANT: Limitation of Liability & Disclaimer

PLEASE READ THIS SECTION CAREFULLY. BY USING OUR SERVICES, YOU ACKNOWLEDGE AND AGREE TO THE FOLLOWING:

3.1 Document Templates Only

SiteReady provides document templates and generation tools only. The documents generated are templates that must be reviewed, verified, and customized by qualified professionals before use.

3.2 No Legal, Safety, or Professional Advice

SiteReady does NOT provide:

Legal advice or legal document preparation services
Professional health and safety consulting
Engineering or technical assessments
Compliance certification or verification
Tender submission assistance or guarantees

3.3 User Responsibility

YOU ARE SOLELY RESPONSIBLE FOR:

Verifying all information in generated documents is accurate and complete
Ensuring documents comply with current legislation (OHS Act, Construction Regulations, etc.)
Having documents reviewed by qualified SHEQ professionals, safety officers, or legal advisors
Obtaining necessary certifications, approvals, and signatures
Keeping documents up to date with changing regulations
All outcomes from using documents generated by our Service

3.4 No Liability for Document Content

SITEREADY SHALL NOT BE LIABLE FOR ANY:

Errors, omissions, or inaccuracies in generated documents
Failed tender submissions or contract awards
Non-compliance with regulations or legislation
Workplace accidents, injuries, or fatalities
Penalties, fines, or legal action from regulatory bodies
Loss of business, contracts, or reputation
Any direct, indirect, incidental, consequential, or punitive damages

3.5 Indemnification

You agree to indemnify, defend, and hold harmless SiteReady, its owners, employees, and affiliates from any claims, damages, losses, or expenses arising from your use of our Services or documents generated through our platform.

3.6 Maximum Liability

In no event shall SiteReady's total liability exceed the amount you paid for the Service in the 12 months preceding the claim, or R1,000 (one thousand Rand), whichever is less.

4. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities under your account.

5. Acceptable Use

You agree NOT to:

Use the Service for illegal purposes or to generate fraudulent documents
Misrepresent company information, credentials, or qualifications
Submit forged or falsified documents to government entities
Share your account with unauthorized users
Attempt to reverse engineer or copy our document templates
Overload our systems or interfere with service operation

6. Intellectual Property

Document templates, software, and platform design are owned by SiteReady. You receive a license to use generated documents for your business purposes only. You may not resell or redistribute our templates.

7. Payments and Subscriptions

Subscription fees are billed according to your selected plan. Payments are processed through PayFast (South African Rand) or PayPal (US Dollar).

Key Points:

5-day cooling-off period for all purchases (subject to usage conditions)
Pro Monthly subscriptions can be cancelled at any time
Document packs (Basic & Premium) are subject to a 72-hour retention policy - download your documents within 72 hours
Full refunds available for technical issues caused by our platform

8. Termination

We may terminate your account for violation of these Terms. You may close your account at any time. Upon termination, your access to the Service and generated documents may be revoked.

9. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of South Africa.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms.
